1. Agreement
This End-User License Agreement (“Agreement”) is between you, or the business you represent (“you”), and Don Short Solutions (“we” or “us”), the owner of SmallBiz App Suite (the “Service”). By creating an account, purchasing a tier, or using the Service, you agree to this Agreement and to our Privacy Policy.
2. License granted
When you purchase a tier (Solo, Team, Commerce, Abacus Pro, or Executive), we grant you a non-exclusive, non-transferable license to use the features of that tier, and of every tier below it, for your own business. Tier purchases are one-time payments. They are not software subscriptions.
3. Recurring fees
- Hosting: every tier carries a $20/month hosting fee, billed directly by Abacus.AI, our hosting provider.
- Executive support plan: the Executive tier includes Ongoing Technical Support & Performance Improvements at $297/month. You may cancel it at any time. If you cancel, you keep your software and data but no longer receive support or improvements.
- Optional coaching memberships are billed monthly and may be canceled at any time.
4. Ownership
The Service, including its software, design, content, and the Alfred assistant, is the property of Don Short Solutions and is protected by copyright and other laws. Your license does not transfer ownership. You may not copy, reproduce, resell, sublicense, reverse engineer, or duplicate the Service without our written consent.
Your data belongs to you. You own the business information and customer records you enter or capture. You grant us only the rights needed to host and process that data to provide the Service.
5. Acceptable use
- Use the Service only for lawful business purposes.
- Obtain any consent the law requires before you email, text, or store information about your contacts. You are responsible for honoring unsubscribe requests, which the Service processes automatically for email sequences.
- Do not send spam, upload malicious code, or try to access other users’ accounts or data.
- Keep your login credentials secure, and tell us promptly about any unauthorized use.
6. Third-party services
Some features rely on third-party services, such as Stripe for payments and Intuit QuickBooks Online for accounting sync. Your use of those services is also governed by their own terms. Connecting them is optional, and you can disconnect them at any time.
7. AI features
AI-generated drafts, roadmaps, reports, calculations, and advice are provided to assist you. They are not professional legal, tax, or financial advice. You are responsible for reviewing AI output before you rely on it or send it.
Alfred’s Read communication profiles are AI estimates of how a contact prefers to communicate, based only on the information you provide. They are not psychological assessments, and you agree not to use them for hiring, employment, credit, insurance, housing, or any other eligibility decision about a person.
8. Free trial
A 7-day free trial may be offered. Trial access is subject to this Agreement.
9. Disclaimer and limitation of liability
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties. Our total liability for any claim relating to the Service is limited to the amount you paid us for your tier in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
10. Termination
We may suspend or terminate access if you materially breach this Agreement. You may stop using the Service at any time and may request a copy of your data.
11. Changes
We may update this Agreement. We will post the new version on this page and change the effective date above. If you keep using the Service after an update, you accept the new terms.
